How do you change a revocable living trust?

 

Joe: I am the trustee of my own trust.

Attorney Tom Olsen: Got it.

Joe: I would like to change my successor trustee, what is the procedure?

Attorney Tom Olsen: You do that through a trust amendment. You're going to amend your trust, changing who the successor trustees will be, who will be trustee when you pass away.

Joe: Right. Do I need to do it through an attorney? Could I just do it myself?

Attorney Tom Olsen: I'm going to recommend that you do it yourself. Now, Joe, here's the other thing I want to tell you. When you did a trust, you did a package of documents, you did a will, you did a financial power of attorney, you did a healthcare power of attorney, in all of those documents you chose who would be taking care of business for you and who's going to make healthcare decisions for you if you're not able to. I'm going to suggest that not only are you going to need to amend your trust, but these other documents are going to have to be redone as well to remove that person that you want to remove.

Joe: Okay. You've explained very well. I thank you so much, sir.

Attorney Tom Olsen: All right, Joe.

Joe: Just one more question if I may ask you. If I did come to you, just a ballpark, what would you charge to do that for me?

Attorney Tom Olsen: Joe, pull out all your documents and take a look at who you've appointed to do these things. Call me up on the phone and say, Tom, I got to change one or two or three or four or five of these documents and that's what's going to determine what our fee is going to be for you, Joe.
