Should your out of state will be reviewed when you move to Florida?

 

When you had your will prepared in another state, you should have it reviewed by a Florida attorney when you move to Florida.

Joseph: Hello.

Attorney Tom Olsen: Hey Joseph, you're on the air.

Joseph: Yes, I moved from El Paso, Texas to Florida in June of last year and I had a Will made up in Texas with a legal attorney. I wonder if I need to remake it for Florida language or is that Will still good in Florida.

Attorney Tom Olsen: Well Joseph here's the good news and the bad news, the good news is that Florida statutes say that if your will was valid when you did it in Texas, it's going to be valid here in the state of Florida, so the will you have is certainly going to work but here's the bad news, when we do wills for people, we do three other related documents. We do a living will where you ask that you not be kept alive by machines, a health care surrogate and a financial power of attorney. Those three documents are all specific to Florida law and they are very important. So Joseph, we might use your will but we still need to do those three documents for you.

Joseph: Okay, how would I get those done?

Attorney Tom Olsen: Well we would love to do them for you Joseph at the Olsen Law Group in Orlando. Joseph the next thing is, once we do those documents for you, in all cases we're talking to our will clients about easy steps they need to take to avoid probate. So Joseph you got a will, but a will has nothing to do with avoiding probate. A will simply directs what happens to your assets when they go through probate. When you come to see us to do those other documents, we're going to do those which are important and critical and we're also going to tell you what you need to do to avoid probate Joseph.
